1        Summary

1.1     The report provides an update on activities at the Golden Bay Recreation Park for the period 1 October 2022 – 15 March 2023.

2        Draft Resolution

2. Considers the Grandstand storage allocation requests (to be sent out ahead of the meeting) and;

3        Purpose of the Report

4        Background and Discussion

 

Event Bookings

 

4.1     The annual Golden Bay A&P show was held at the Golden Bay Recreation Park on Saturday 21 January 2023. Due to the Covid Pandemic this was the first time the show had been held since 2020. There was a good attendance by the public, helped by the favorable weather on the day.

The Mayor Tim King along with Hazel Pearson, Duncan McKenzie and Noel Baigent officially opened the renovated Recreation Park Grandstand during show day.

 

4.2     The Golden Bay Football Club held the ‘Battle of the Bays’ on 25 February to raise money for a mental health charity called ‘Hope is my Homeboy’.  It was a successful day with fine weather and the club ended up raising approximately $10,000 for the cause. I would like to thank Phil Smith and the Golden Bay AFC for their commitment and dedication in organising this event for the Golden Bay Community.

        Operational Activities

 

Golden Bay Grandstand Project

 

4.3     The Grandstand strengthening project is complete and Code of Compliance is expected in the next month.

 

4.4     The car park and drainage works are complete, and a total project cost will be presented at the Committee meeting on 29 March.

 

4.5     An update on the Code of Compliance for the Golden Bay Rec Centre will also be presented at the Committee meeting on 29 March.

 

4.6     The Grandstand Trust have requested to install some heritage boards (Attachment A) on the Grandstand at their cost.

 

4.7     The proposed location of these boards is on the back wall of the Grandstand seating area. Staff request that the Committee provide feedback on this location.

 

4.8     Staff propose to give approval for these boards with the following conditions.

 

4.8.1  Council will cover the cost of on-going Heritage Panel cleaning and maintenance.  This will not extend to replacement of panels should they be vandalised or deteriorate beyond repair. 

          Council reserves the right to remove the heritage panels should they become a potential health and safety hazard.  

4.8.2  Should the contents of the boards be changed at any point, approval must be sought by the Council Communications Manager.

 

Grandstand Storage Allocation

 

4.9     Staff have prepared a plan of the potential storage areas under the Grandstand and have sent it out to the various groups at the Rec Park. Expressions of Interest have been requested from the groups to determine what storage areas they would like to secure under the stand. 

 

4.10   Expressions of interest will be circulated to Committee members prior to the March meeting so they can be considered.  

 

4.11   Staff will then prepare hire agreements for the successful groups that are allocated storage  areas.

 

4.12   The main terms of the proposed hire agreement are;

 

4.12.1  A 2 year term for each area of allocation and a peppercorn rental charged. Prior to the expiry of the term a new application from each group will be required.

4.12.2  Storage items must only include equipment and materials relating to the organisation’s primary activity.

4.12.3  Inspections of the storage areas and items stored will be conducted annually to ensure compliance with the terms and check for any potential health and safety issues.

4.12.4  Items can only be stored in the allocated areas and identified access ways must not be obstructed.

4.12.5  Items are stored at each groups risk and Council will not be liable for loss or damage.

4.12.6  Access only available to add to or remove items, area shall not be used for any other purpose.

 

Football 

 

4.13    Staff have been working closely with Phil Smith of Golden Bay AFC.  Over winter, and with the help of Nick Hofmann of Nelmac the football pitches were renovated in preparation for the current season. 

 

4.14   In mid February the pitches were line marked by Nelmac for The ‘Battle for the Bay’ charity football competition which took place on 25th February. 

 

4.15   Ahead of the Battle for the Bay competition due to the unseasonably wet weather an overburden of cut grass remained after the mowing.  The spring pitch renovations combined with the wet and warm weather resulted in accelerated grass growth. The grass was eventually cut to the required length prior to the competition.

 

4.16   Pre-season football training is under way and Phil Smith of GBAFC advised that registrations for football are up on last year’s figures with 358 players and 20 teams all turning out to play for the club. 

 

4.17       We are continuing to work with Phil Smith and the GBAFC to replace the training floodlights on the southern side of the football pitches.  We are also in discussion about improving the quality of the playing surfaces of the football pitches to cater for the increase in new talent.

 

Rugby 

 

4.18   On March 16th Rob Coleman, Council’s Reserves Officer – Recreation and Systems, met with Golden Bay Rugby who would like to  secure funding to install more floodlights on the rugby pitches. Further details on this will be provided once the Rugby Club have progressed their plans.

 

Electrical Transformer Box

 

4.19   Regarding the recently installed electrical transformer cabinet that is located behind the Grandstand on Golden Bay A&P Association land, Council’s Project Team has forwarded an outline plan to the A&P Association and are currently awaiting a response.  Once comment is received Council’s lawyers can proceed with lodging the easement.

7.2     Lease Application Mohua MenzShed

1        Summary

1.1     The Mohua MenzShed have applied to lease a small area at the Golden Bay Recreation Park for a workshop.

1.2     The Reserve is a Recreation Reserve vested under the Reserves Act 1977. The lease would be granted under Section 54 (1) (c) of the Act as the workshop will require substantial expenditure. Therefore a lease of a 33 year term is considered appropriate.

1.3     The Intention to Lease has been publicly notified and 26 submissions all in favour of the lease were received. The Committee will consider the submissions and a recommendation to Council for the granting of a lease.

1.4     The proposal for a MenzShed is appropriate to be sited on the Reserve and the impacts are considered to be minor and meet the requirements of the Reserve Act and the Reserves General Policies.

 

2        Draft Resolution

 

That the Golden Bay Rec Park Management Committee:

1.       Receives the Lease Application Mohua MenzShed Report RGBRPM23-03-2; and

2.       Recommends to the Council that having considered the submissions on the intention to lease that a lease of approximately 286m2 of the Golden Bay Recreation Park is granted to the Mohua MenzShed for the purposes of a workshop facility for a term of 33 years.

3        Purpose of the Report

3.1     This report seeks consideration of an application from the Mohua MenzShed (MenzShed) to lease an area of approximately 286m2 on the northern side of the Golden Bay Recreation Park parallel to Park Avenue for the purpose of constructing and operating a workshop area for their activities. The MenzShed are seeking a lease term of 33 years to recognise a proposed investment of more than $850,0000 for the building, driveway and parking.

3.2     The intention to lease has gone through a process of public notification and 26 submissions all in support of the proposal were received.

3.3     The Council will make the final decision on the granting of a lease so the role of this Committee is to make a recommendation to Council confirming that it has considered the submissions and is either in support or opposition to granting a lease.

 

4        Background and Discussion

Background

4.1     The MenzShed first approached the Council in late 2020 seeking a site for a MenzShed workshop. At that time they were considering relocating an old classroom block from the Takaka High School to the Park. A site on the fenced area on the northern side of the Park formerly used by the A&P Society for holding stock during the show was considered. They did not proceed with this building and decided to build a purpose built workshop. This site was considered to be the most appropriate for their needs.

4.2     The group proceeded to register as an Incorporated Society and gain charitable status which was achieved in 2021. This makes them eligible for grant funding and formalises their status as a Community Group. The MenzShed meets the leasing requirements of the Reserves Act 1977 as a Community Group not directly associated with outdoor recreation.

4.3     The MenzShed prepared some initial sketches for a workshop and then secured the services of an architect to prepare concept drawings. The drawings were presented informally to this committee in December 2022. An elevation, a perspective drawing and a site plan are included as Attachments 1-3 of this report. The drawings show the development of the building in several stages as funding through grants and other sources becomes available. They have also given consideration to the sharing of facilities with other groups.

Evaluation of Proposal

4.4     The MenzShed proposal outlines their Mission as: To provide a welcoming and inclusive space for all men to attend and find companionship, a learning environment, a place to spend time on personal and community projects and to get to know other men in the community. Our focus is on our members health and wellbeing, by providing a physical gathering point with all the tools and gear necessary to complete projects and a supportive open minded group of men whose goal is to contribute to the wellbeing of the local community and the people within that. Thus providing our members with friendship and a sense of purpose.

4.5     The group currently has an active committee with a small membership comprising a core group of 10 who are fully involved. As they have not been operating for more than 12 months and as yet do not have a suitable premise, because of this they are not encouraging new members although they have a prospective membership of at least 30 plus interested persons. They have discussed sharing the facility with other community groups and have had interest from groups including, Women’s Craft, Golden Bay Work Centre Trust, Home Schoolers and Evening Class persons.

4.6     While the group is currently small, they have been very active in supporting groups in the community as evidenced by the number of positive submissions supporting their lease application.

4.7     The MenzShed activity provides strong community benefits and has been involved in a number of projects with benefits to other community organisations and in Council Reserves contributing for example to a bird hide and a shorebird art project.

4.8     The need to locate on reserve land is linked to the community benefits generated by the group and the difficulties in securing a lease on private land due to lack of security and ground rents. The workshop would be sited on a centrally located recreation reserve which is already a hub for other community groups which generates synergies and collaboration opportunities.

4.9     The proposed location on the reserve would be low impact and sits well in the landscape. The concept plans show it to be an appropriate size and scale, gives consideration to amenities such as toilets and meeting spaces and provides good access and parking. Impacts beyond the reserve will be assessed through a resource consent application.

4.10   The Golden Bay Recreation Park in addition to providing sports fields both grass and artificial surfaces also has leases to a variety of other Community Facilities such as the Drama Society and Red Cross. The reserve is a hub for sports and other community groups in the Golden Bay Ward and is well sited in close proximity to the Takaka township. This lease would therefore add to and enhance the mix of community recreation facilities at the park.

5.2     Option 1 is recommended.

         

6        Strategy and Risks

6.1     This is a low risk decision that gives consideration to the use of an existing reserve by a community group who currently have no permanent facility and are currently in rented accommodation. The application aligns with Council policy for the use of reserves.

6.2     This decision will result in an increase in greenhouse gas emissions through building materials used in construction. The group will be encouraged to discuss waste minimisation and try and select building materials that minimise emissions.

 

7        Policy / Legal Requirements / Plan

.7.1    The land known as Golden Bay Recreation Park is gazetted as the Golden Bay Recreation Showgrounds Recreation Reserve under the Reserves Act 1977 (Act), the land was transferred to the Council at nil consideration in 1959 and then a further area transferred in 1986 from the Golden Bay Agricultural and Pastoral Association under the Reserves and Other Lands Disposal Act 1959.

7.2     The land is described as Part Section 1 of Section 22 Takaka Block X Waitapu Survey District and contained in Certificate of Title NL62/224.

7.3     The proposed lease area is on land within the Spain Award Area, therefore the Council has sought and obtained the approval of Wakatū Incorporation to this lease as it constitutes a technical disposal.

7.4     The Act requires (S.54 (2) & (2A)) that a lease of part of a recreation reserve is publicly notified unless the lease is contemplated in an approved management plan. The Golden Bay Ward Reserves Management Plan 2003 makes no provision for a lease to the MenzShed therefore the lease was notified in accordance with the Reserves Act 1977 on 3 February 2023 with the submission period closing on Friday 3 March 2023.

7.5     There were 26 submissions received from both residents and community groups all in support of granting a lease to the MenzShed , there were no submissions opposing the granting of a lease. A list of submitters and the content of their submissions is included as Attachment 4 to this report. The Committee needs to consider the submissions, all are supporting a lease and most are also endorsing the activities and role that the MenzShed provides in the Golden Bay community.

7.6     The leasing powers in respect of a recreation reserve for the purpose of an activity such as a MenzShed is provided under S. 54 (1c) of the Act, this section provides for leases to a voluntary organisation for a building or structure for public recreation not directly associated with outdoor recreation. Section 54 also requires the prior consent of the Minister to a lease however, this was included in a 2013 delegation to Local Authorities for reserve land under their control, this delegation will be exercised by Council as part of their determination on the proposal.

 

8        Consideration of Financial or Budgetary Implications

8.1     The MenzShed will fund through grants and other sources the workshop facility, no funding input is sought from the Council other than the provision of the site. There are no budgetary or financial implications to Council arising from the granting of a lease.

9.1     The overall significance is considered to be low to moderate.

10      Conclusion

10.1   The MenzShed are seeking a lease of an area of Golden Bay Recreation Park to build and operate a workshop for their activities. Due to the construction costs they are seeking a long term lease of 33 years. Their activities are appropriate to be located on a Recreation Reserve and the site sought is considered to be a good use of reserve land. The intention to lease has been publicly notified in accordance with the Reserves Act 1977 and 26 submissions of support and no submissions opposing the lease were received. The submissions have been considered and given the extent and level of support it is a recommendation to the Council that a lease is granted.

 

11      Next Steps / Timeline

11.1   A report will be provided to the April Council meeting seeking approval of the lease by Council in its own right and under a delegation from the Minister of Conservation.

11.2   The MenzShed will be given an approval to lease which can be executed once they have funding and the relevant consents in place.
