1        OPENING, WELCOME

The Chair invited Group Manager – Community Infrastructure, Richard Kirby, to open the meeting with karakia.

3        Public Forum

 

3.1     Alcohol Healthwatch - Andrew Galloway

Andrew Galloway spoke to a PowerPoint presentation, which is available on Council’s website in the Minutes Attachment document. He answered questions and highlighted why alcohol and sport did not mix and congratulated the Councils on their previous decision regarding alcohol advertising.

He requested that Alcohol Healthwatch work with the Councils and negotiate a middle ground with NZ Cricket on alcohol advertising, noting the potential for non-alcoholic product advertising.

3.2     National Public Health Service - Health NZ/Te Whatu Ora - Hana Wilkinson, Dr Rachel Eyre and Jay Blazek

Hana Wilkinson, Dr Rachel Eyre and Jay Blazek spoke to the PowerPoint presentation, which is available on the Council’s website in the Minutes Attachment document. They gave an overview of the presentation, and noted support for Alcohol Healthwatch’s view.

They asked that Council carefully consider the community voices, continue to show leadership, and adequately weigh up the harm as well as the benefits. This included full consultation with those most impacted, particularly Te Tauihu iwi.

3.3     Bruce Struthers - Contemplated change in alcohol advertising.

Bruce Struthers displayed two videos during his public forum presentation, links to these are available on the Council’s website in the Minutes Attachment document.

Mr Struthers spoke about information technology and the effectiveness of media.  He felt that NZ Cricket had dropped the ball gaining an alcohol sponsor once the Councils had made their decision regarding alcohol advertising. He felt that the NZ Cricket benefits to Nelson Tasman were weak and requested no alcohol advertising at Saxton Field at any time.

3.4     Neville Mayall – Saxton Field alcohol advertising

Neville Mayall spoke about Saxton Field, and asked what about Trafalgar Park? He provided a brief history of alcohol at sports events. He noted a major study by Massey University about alcohol consumption at sporting events, and said the main findings were that rugby and tennis audiences had the highest consumption, with cricket at low levels in comparison.

 

4        DECLARATIONS OF INTEREST

Councillor Brent Maru noted that he was comfortable with being involved in today’s decision to undertake consultation, but that because of their roles as Chair and Deputy Chair of the Tasman District Licensing Committee (DLC) and a perceived conflict of interest, he and Councillor Ellis would be stepping back from the submissions hearing and deliberations, and that Councillors Dowler and Daikee would sit on the Hearings Panel in their place.

The Chair, Derek Shaw, declared that he was a member of Nelson DLC, but that he would not be taking part in any DLC decision-making related to Saxton Field whilst the public consultation and subsequent hearings and deliberations were taking place and therefore did not feel conflicted taking part in the submissions hearing and deliberations.

7        Reports

 

7.1     Proposed amendments to the Saxton Field Reserve Management Plan relating to alcohol advertising at Saxton Field

Nelson City Council Principal Planner Parks and Facilities, Paul Harrington, presented the report, noting that he had tried to work through this issue with an open mind. He felt that broadening the scope of the amendments wider than cricket was not appropriate at the moment and clarified that this was not a comprehensive review of the Reserve Management Plan.

Nelson City Council Group Manager Community Facilities, Andrew White, provided an alternative recommendation  proposing to broaden clause 4.8.2.4 in the Reserve Management Plan, to reflect that there was a possibility that other events may come up in future that may have sponsorship deals in place that the Councils would need to consider at the time.

Mr Harrington answered questions on the report.

Discussion took place on the alternative recommendation but it was not moved or seconded and the substantive motion was put.

That the Saxton Field Committee

1.   receives the Proposed amendments to the Saxton Field Reserve Management Plan relating to alcohol advertising at Saxton Field   report (R28393) and its attachments (1982984479-6670, 196698121-56176 and 196698121-56658); and

2.   determines under s41(5A) of the Reserves Act that written suggestions on the proposed amendments to the Saxton Field Reserve Management Plan would not materially assist in its preparation; and

3.   agrees that the proposed amendments to the Saxton Field Reserve Management Plan are not a comprehensive review of the management plan and the Councils may therefore follow the procedure that they think fit having regard to sections 41(5) and (6) of the Reserves Act 1977 and the decision-making requirements of Part 6 of the Local Government Act 2002; and

4.   adopts the draft amendments to the Saxton Field Reserve Management Plan as provided in Attachment 3 to report R28393 (196698121-56658) for public consultation; and

5.   agrees to consult on the proposed amendments to the Saxton Field Reserve Management Plan for a three week consultation period, to be confirmed dependent on the Chair’s availability and that this meets the requirements of section 41 of the Reserves Act 1977 and Part 6 of the Local Government Act 2002, including the consultation principles in section 82; and

6.   agrees that the proposed amendments to the Saxton Field Reserve Management Plan will be publicly notified in Newsline, Our Nelson and on both Councils’ websites; and

7.   delegates authority to the Chair of the Saxton Field Committee, Tasman District Council Group Manager Community Infrastructure and Nelson City Council Group Manager Community Services to approve minor changes to the draft amendments to the Saxton Field Reserve Management Plan before it is publicly notified; and

8.   appoints a Hearings Panel to hear and deliberate on the submissions received on the draft amendments to the Saxton Field Reserve Management Plan and to make a recommendation to the Joint Committee, with the membership comprising of:

·         Chairperson Derek Shaw

·         Nelson City Councillors – Tim Skinner and Campbell Rollo

·         Tasman District Councillors – Glen Daikee and Barry Dowler; and

9.   notes the Hearings Panel quorum of 3 members, with a minimum of 1 Elected Member from each Council.
